“Alvendia, Kelly & Demarest has had great success in civil litigation both inside and outside the courtroom. The Firm’s philosophy is that if a case can be settled for the maximum amount reflected by the current case law and the client is satisfied, then its mission is accomplished. However, every case that the Firm handles is prepared thoroughly as if it is going to trial. Therefore, if an acceptable settlement cannot be reached then the Firm is ready to go to trial to get the maximum award from a judge or jury. In all thousands of cases have been successfully handled by Alvendia, Kelly & Demarest and hundreds of those cases were successfully handled at trial.
The following are some of the Firm’s recent noteworthy cases, (due to confidentiality agreements some of the names of the Firm’s clients are omitted):
In 2003, Alvendia, Kelly & Demarest went to trial in the case of Schreiber vs JCC, and won a $17,000,000 jury verdict in the Civil District Court of New Orleans. The case involved a local athletic club, wherein the Firm’s client, Mr. Schreiber, sustained serious spinal injuries in accident. His injuries rendered the healthy young athlete confined to a wheelchair. The Firm was able to prove to the jury at trial that the athletic club was negligent in the maintenance and operations of its facility, which caused Mr. Schreiber’s life changing accident.
In 2004, Alvendia, Kelly & Demarest went to trial in the Civil District Court of New Orleans and won a 3.25 million verdict for a New Orleans man who was seriously injured in a house explosion. The Firm proved at trial that the landlord of the home was negligent when he covered an exposed gasoline in the kitchen, which resulted in the explosion. The Firm’s client had multiple back, shoulder and knee surgeries as a result of the explosion.
In 2005 1.7 million was obtained by Alvendia, Kelly & Demarest in settlement for a New Orleans lady who was exposed to chemicals that leaked from an 18 wheeler as it was transporting the chemicals across the country. The Firm showed that the transporter’s negligence resulted in serious inhalation injuries to the Firm’s client
In 2007, Alvendia, Kelly & Demarest obtained a multi-million dollar settlement for a Jefferson Parish man who was rear ended in a traffic accident. The auto accident resulted in a complex spinal surgery, which ended the man’s professional career. The Firm was able to settle the case for an amount that took into consideration their client’s injuries and his future loss wages.
In 2008, 2 million dollars was obtained by Alvendia, Kelly & Demarest in a settlement for a local New Orleans businessman who’s restaurant and catering businesses were seriously affected by Hurricane Katrina. The businessman fought a tough but unsuccessful battle with his own insurance company for months until Alvendia, Kelly & Demarest was hired to handle his claim.
In 2008, Alvendia, Kelly and Demarest also obtained a 1.9 million dollar settlement for a group of New Orleans medical clinics that had severe business losses after Hurricane Katrina. The medical clinics also fought with their own insurance company for years until Alvendia, Kelly & Demarest got involved, prepared the case for trial, and successfully obtained enough funds for the medical clinics to recover their loss revenues. |
