Class Actions

The Law Firm of Alvendia, Kelly & Demarest applies their same aggressive and hard work approach to several class action cases in which they represent thousands of victims of big business negligence. The Firm has been appointed by the Courts in the following cases to be part of the PSC or the Plaintiff Steering Committee, which is the group of experienced attorneys who jointly represent the interests of the class of plantiffs and finance the costly litigation.

1.    Preston vs. Memorial Hospital and Tenet Health Care Systems, currently pending in the Civil District Court of New Orleans.

In the face of the imminent approach of Hurricane Katrina, the most catastrophic hurricane to hit New Orleans in modern day history, the corporation that operated Memorial Hospital in New Orleans made a decision to not evacuate hundreds of patients, employees, guests and family members from its hospital location. Alvendia Kelly & Demarest is part of the seasoned team of lawyers on the Plaintiff Steering Committee for this class action case, which is not against the brave doctors and nurses who stayed behind to care for their patients. Instead, this case is aimed at the corporation, Tenet Healthcare Corporation, which after Katrina has abandoned its business locations in Louisiana.  The "class" of plaintiffs in this case is made up of of all people who were stranded at Memorial Hospital before, during, and after katrina passed through New Orleans. Therefore, this class action will bring justice to the hundreds of people who suffered injuries and death as they and/or their loved ones were desperately trapped at the flooded hospital for days in unbearable heat and in unsanitary conditions. Alvendia, Kelly & Demarest will be part of the legal team that ensures this Tenet Healthcare Corporation and other medical corporations like it will act responsibly in the face of future natural disasters, which will hopefully save the lives of countless people.

Alvendia, Kelly and Demraest has also been appointed in the following class action cases that involved similar circumstances to the Memorial Hospital case described above. Again, the following class actions involve thousands of people who were not evacuated from medical facilities prior to Katrina, which resulted in injuries and death to many patients. These class actions cases are also not against the doctors or nurses, rather they are against the medical corporations who acted negligently in failing to evacuate their medical facilities and failing to properly prepare their facilities prior to the arrival of Hurricane Katrina. The Firm represents the classes of plaintiffs in the following cases

Lindy Boggs

Weems vs. Lafon Nursing Home

Mehtodist and Lakeland Hopsital

Chalmette Medical Center

In addiiton to the above mentioned hospital class actions, Alvendia, Kelly and Demarest are part of the legal teams in the following class actions:
